New York State Department of Environmental Conservation (DEC) Region 5 Environmental Conservation Police were busy enforcing against poaching activities during the recently ended big game season.
On November 29, 2011, an Environmental Conservation Officer (ECO) was interviewing a witness as part of investigating a possible hunter trespass complaint in the Town of Benson, Hamilton County. The witness reported confronting three men allegedly on property without the owner’s permission and attempting to retrieve a female bear that they had previously shot in its den. After observing the dead bear in the den, the ECO followed human tracks to a camp on an adjacent property. Finding nobody present the ECO staked out the camp and when two of the men returned observed them attempting to clean alleged bait pile and salt licks. After interviewing the two men the ECO instructed them to retrieve the dead bear and to have all three men meet with him at the camp the next day. On November 30, 2011, the ECO seized the bear and issued multiple tickets to each of the men returnable to the Town of Benson Court as follows:
- Benjamin I. Van Nostrand, 38, of Northville was charged with aiding in the illegal taking of a bear, a misdemeanor, and trespassing while hunting and unlawful feeding of deer, both violations. He faces maximum possible penalties of $2500 in fines and up to 1 year in jail.
- Daniel J. Van Nostrand, 40, of Edinburg, was charged with the illegal killing of a bear, a misdemeanor, and two violations – hunting with the aid of bait, trespassing, failing to tag a bear as required. He faces maximum possible penalties of $2750 in fines and up to 1 year in jail.
- George J. Van Nostrand, 36, of Northville, was charged with trespassing on posted property, a violation. He faces maximum possible penalties of $250 in fines and up to 15 days in jail.
On Tuesday, January 10, 2012, two DEC ECOs investigated a complaint of antlered deer shot near Lindsday’s Orchard’s in the Town of Clifton Park, Saratoga County. The deer was reportedly shot under the apple orchard’s nuisance deer permit, which allow only for the taking of antlerless deer. The ECOs reviewed the permit and associated paperwork and interviewed the orchard’s caretaker and another worker. Upon concluding the investigation, Duane R Lindsey, 59, of Rexford was charged with taking big game out of season, taking deer with the aid of an artificial light – both misdemeanors, and violating the terms and conditions of a deer nuisance permit, a violation. He was issued an appearance ticket for the Town of Clifton Park Court and faces maximum possible penalties of $4250 in fines and up to 2 years and 15 days in jail. In additions the deer’s antlers were seized as evidence, the remaining nuisance permits were confiscated, and the permit was terminated.
In a matter closely followed by the public, but not related to enforcement of hunting laws and regulation, two Essex County men have been convicted and sentenced following an incident in which they struck Great Blue Heron with rocks on August 8, 2011 in the Town of Jay, Essex County. The bird was severely and had to be euthanized shortly after the incident due to the extent of damage to one of its wings.
Michael W. Martindale Jr., 29, of Jay was convicted On December 12, 2011, of illegally taking wildlife and taking a protected bird and fined $502.50 by the Town of Jay Court. Ryan Slater, 22, of Wilmington was previously convicted of torturing an animal under the Agriculture and Markets Law on October 17, 2011, in the Town of Jay Court. Slater was sentenced to 60 days in jail and was returned to state prison for four years for violating his status as a parolee.

Clinton County
On November 12, 2011, Norman C. Shappy, 46, of Peru was charged with using a spotlight with an unsecured long gun in a motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Black Brook Court. Shappy faced maximum possible penalties of $1000 in fines and up to three months in jail. He paid a $300 fine in a settlement agreement.
On November 12, 2011, Matthew G. Heywood, 34, of Rhode Island was charged with the use of a spotlight on lands inhabited by deer with an unsecured firearm in a motor vehicle, a misdemeanor. He was issued an appearance ticket returnable to the Town of Black Brook. Heywood faces maximum possible penalties of $1000 in fines and up to three months in jail.
On November 12, 2011, Timothy A. Heywood, 48, of Blackstone, MA, was charged with use of a spotlight on lands inhabited by deer with an unsecured firearm in a motor vehicle, a misdemeanor. He was issued an appearance ticket returnable to the Town of Black Brook. Heywood faces maximum possible penalties of $1000 in fines and up to three months in jail.
On November 21, 2011, Randall P Riley, 48, of Wilmington was charged with using a spotlight with an unsecured long gun in a motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Black Brook Court. Riley faced maximum possible penalties of $1000 in fines and up to three months in jail. He paid a $300 fine as part of a settlement agreement.
On November 21, 2011, Patrick John Santamaria, 45, of Ausable Forks was charged with using a spotlight with an unsecured long gun in a motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Black Brook Court. Santamaria faced maximum possible penalties of $1000 in fines and up to three months in jail. He paid a $300 fine as part of a plea agreement.
On November 27, 2011, Matthew A Koskinen, 23, of Redford was charged with possessing a loaded long gun in a motor vehicle, a misdemeanor offense. He was issued an appearance ticket for the Town Black Brook Court. Koskinen faces maximum possible penalties of $1000 in fines and up to three months in jail.
On December 2, 2011, Robert L. Tender, Sr., 66, of Black Brook was charged with illegal feeding of deer and placing a salt lick, both violations. He was issued appearance tickets for the Town of Black Brook Court. Tender faces maximum possible penalties of $500 in fines and up to 15 days in jail.
On December 4, 2011, a 16 year old male from Peru was charged with taking an anterless deer without a permit and taking big game during the closed season, both misdemeanors. He was issued appearance tickets for the Town of Peru Court. Mashtare faces maximum possible penalties of $4000 in fines and up to one year in jail.
On December 10, 2011, JeanGuy Colpron, 65, of Ste Martine, QC, was charged with possessing a loaded firearm in a motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Clinton Court. Colpron faces maximum possible penalties of $1000 in fines and up to three months in jail.
On December 10, 2011, Arlen J. Favero, 76, of Plattsburgh was charged with illegally taking deer, possessing a loaded firearm in a motor vehicle, both misdemeanors and hunting deer with the aid of a pre-established bait pile, a violation. He was issued appearance tickets for the Town of Clinton Court. Arlen faces maximum possible penalties of $3250 in fines and up to one year in jail.
On December 10, 2011, Dennis E. Lashway, 47, of Malone was charged with two misdemeanor counts of illegally taking deer, a taking an anterless deer without a permit – also a misdemeanor, and hunting deer with the aid of a pre-established bait pile and hunting without a license – both violations. He was issued appearance tickets for the Town of Clinton Court. Lashway faces maximum possible penalties of $6500 in fines and up to one year in jail.
On December 10, 2011, Marvin F. Bordeau, 74, of Plattsburgh was charged with a misdemeanor for possessing a rifle afield during the muzzleloader season, and three violations – hunting deer with the aid of a pre-established bait pile, possessing a tag of another and the unlawful feeding of deer. He was issued appearance tickets for the Town of Clinton Court. Bordeau faces maximum possible penalties of $1750 in fines and up to three months in jail.
On December 10, 2011, Ricky S. Lashway, 57, of West Chazy was charged with the unlawful feeding of deer and operating an ATV without a helmet, both violations. He was issued appearance tickets for the Town of Clinton Court. Lashway faces maximum possible penalties of $350 in fines and up to 15 days in jail.
Essex County
On November 10, 2011, Phillip R. Perry Jr., 37, of Lake Placid was charged with taking in excess of seasonal bag limits of big game, a misdemeanor, and possessing the carcass tag of another, a violation. He was issued an appearance ticket for the Town of Santa Clara Court. Perry faces maximum possible penalties of $2250 in fines and up to one year in jail.
On November 11, 2011, Harold Bailey, 56, of Keeseville was charged with possessing a firearm while using artificial lights on lands inhabited by deer, a misdemeanor. He was issued an appearance ticket for the Town of Chesterfield Court. Bailey faces maximum possible penalties of $1000 in fines and up to three months in jail.
On November 12, 2011, Matthew Cornick, 24, of Schuyler Falls was charged with hunting deer over pre-established bait pile and hunting big game without a valid hunting license, both violations. He was issued appearance tickets for the Town of Jay Court. Cornick faced maximum possible penalties of $500 in fines and up to 30 days in jail. He pled guilty and paid a $200 fine.
On November 11, 2011, Jason W. Andrick, 38, of Shaftsbury, VT, was charged with possessing a loaded long gun in a motor vehicle, a misdemeanor. On October 27, 2011, Neil E. Martin, 23, of North Bangor was charged with possession of loaded firearm in motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Bangor Court. Martin faces maximum possible penalties of $1000 in fines and up to 3 months in jail.
On October 28, 2011, George Oehler, 46, of Gabriels was charged with failing to carry hunting license, placing a salt lick on lands inhabited by deer, hunting big game over bait and hunting big game during closed hours, all violations. He was issued appearance tickets for the Town of Santa Clara. He faces maximum possible penalties up $1000 and up to 15 days in jail.
On October 29, 2011, Steve M. Laporte, 53, of Morrisonville was charged with unlawful feeding of deer, a violation. He was issued an appearance ticket for the Town of Bellmont Court. Laporte faces maximum possible penalties of $250 in fines and up to 15 days in jail.

On November 11, 2011, William Siskavich, 52 of Saranac was charged with hunting big game over bait, failure to carry hunting license, operating a motorized vehicle on state land and operating an unregistered ATV, all violations. Siskavich was fined $425 by the Town of Franklin Court.
On November 15, 2011, William Goodman, 47 of Gabriels was charged with placing salt on lands inhabited by deer, hunting big game over bait and hunting during closed hours, all violations. He was issued appearance tickets for the Town of Santa Clara. He faces maximum possible penalties of $750 and up to 15 days in jail.
On November 23, 2011, Wayne C. Lamica, 59, of Malone was charged with hunting deer over bait and the unlawful feeding of deer, both violations. He was issued an appearance ticket for the Town of Malone Court. Lamica faces maximum possible penalties of $500 in fines and up to 15 days in jail.
On November 24, 2011, John F. Tyler, 48, of Peru, was charged with hunting deer over bait, a violation, and illegally taking a deer, a misdemeanor. He was issued appearance tickets returnable to the Town of Franklin Court. Tyler faced maximum possible penalties of $2250 in fines and 90 days in jail. He was fined a total of $775.
On December 3, 2011, Kyle J. Reynolds, 27, of Morrisonville was charged with hunting deer over bait and the unlawful feeding of deer, both violations. He was issued appearance tickets for the Town of Burke. Reynolds faces maximum possible penalties of $500 in fines and up to 15 days in jail.
On December 6, 2011, Charles J. Schloer, 29, of Brasher Falls, was charged with possession of loaded firearm on motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Bombay Court. Schloer faces maximum possible penalties of $1000 in fines and up to three months in jail.

On November 13, 2011, Lee A Moore, 28, of Dolgeville was charged with the illegal possession of a doe deer, A violation. He was issued an appearance ticket for the Broadalbin Town Court. Moore faces maximum possible penalties of $250 in fines and up to 15 days in jail.
On November 18, 2011, Timothy J Snell Jr., 23, of Johnstown was charged with trespassing while hunting on posted property, a violation. He was issued an appearance ticket for the Caroga Town Court. Snell faces maximum possible penalties of $250 in fines and up to 15 days in jail.
On November 19, 2011, Craig T Lamphere, 34, of Little Falls, was charged with hunting deer with the aid of bait and the illegal feeding of deer, both violations. He was issued appearance tickets for the Oppenheim Town Court. Lamphere faced maximum possible penalties of $500 in fines and 15 days in jail. He paid fines and surcharges totaling $650.
Michael J McElroy, 47, of Wells, was charged with two misdemeanors – shooting from a highway and possessing a loaded gun in a motor vehicle, and three violations – attempting to illegally take a deer, attempting to take deer from a motor vehicle and attempting to take deer from a roadway, all relating to a November 22, 2011 incident. He was issued appearance tickets for the Ephratah Town Court. McElroy faces maximum possible penalties of $2750 in fines and up to 90 days in jail for these charges. McElroy was also charged with a misdemeanor reckless endangerment for allegedly discharging a firearm in close proximity to a passing motorist at the time of committing the above offenses.
On November 27, 2011, Kevin P Johnson, 47, of Ilion was charged with the illegal taking of deer during a closed season, a misdemeanor, and three violations – illegal possession of a deer, failing to tag a deer as required and failure to report harvest violations. He was issued appearance tickets for the Oppenheim Town Court. Johnson faces maximum possible penalties of $2750 in fines and up to 1 year in jail.

On November 12, 2011, Peter Hunkins, 51, of Lake Placid was charged with discharging a firearm within 500 feet of a residence, a misdemeanor. He was issued an appearance ticket for the Long Lake Town Court. The charge was dropped as part of a settlement agreement in which Hunkins paid $352.50 in fines.*
On December 3, 2011, Brian K Scism, 41, of Phoenicia was charged with placing salt on lands inhabited by deer, a violation. He was issued an appearance ticket for the Arietta Town Court. Scism faces maximum possible penalties of $250 in fines and up to 15 days in jail.
Saratoga County
On November 15, 2011, Justin J Carr, 26, of Saratoga Springs was charged with use of a spotlight from a motor vehicle while in possession of an unsecured firearm, a misdemeanor. He was issued an appearance ticket for the Town of Northumberland Court. Carr faces maximum possible penalties of $1000 in fines and up to 90 days in jail.
On November 15, 2011, Christopher M Columbe, 26, of Saratoga Springs was charged with use of a spotlight in a motor vehicle while in possession of an unsecured firearm, a misdemeanor. On November 21, 2011, Lance K. Matter, of Milton was charged with a misdemeanor for illegally taking deer, and two violations – hunting over bait and feeding deer. Matter was issued appearance tickets for the Town of Milton Court and paid $750 in fines.
On November 24, 2011 Douglas S Chamberlain, 49, of Broadalbin, was charged with possessing a loaded firearm in a motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Providence. Chamberlain faces maximum possible penalties of $1000 in fines and up to 90 days in jail.
On November 27, 2011, Leo A. Bouleris, of Clifton Park was charged with possessing a loaded firearm in a motor vehicle. He was issued an appearance ticket for the Town of Stillwater Court. Bouleris faces maximum possible penalties of $1000 in fines and up to three months in jail.
On November 27, 2011 Justin J Derusha, 20, of Gansevoort was charged with a misdemeanor for discharging a firearm within 500 feet of a dwelling and two violations – unlawful possession of a turkey and failure to tag deer. He was issued appearance tickets for the Town of Northumberland. Derusha faces maximum possible penalties of $1500 in fines and up to 120 days in jail
On December 4, 2011, Jason D Kelly, 30, of Greenfield Center was charged with possession of a loaded firearm in a motor vehicle, a misdemeanor. He was issued an appearance ticket for the Town of Greenfield. Kelly faces maximum possible penalties of $1000 in fines and up to 90 days in jail.
On December 5, 2011, Jeffry H. Klein, 59, of Clifton Park was charged with discharging a firearm within 500 feet of a dwelling and illegally killing a deer, both misdemeanors. He was issued appearance tickets for the Town of Clifton Park Court. Klein faces maximum possible penalties of $3000 in fines and up to 15 months in jail.
Warren County
On November 22, 2011, Shawn M. Pelkey, 47, of Lake George was charged with possessing a loaded firearm in a motor vehicle, shooting from a roadway, and discharge of a firearm within 500 feet of a dwelling – all misdemeanors. He was issued summonses to appear before the Queensbury Town Court. Pelkey faces maximum possible penalties of $3000 in fines and up to 90 days in jail.
On December 11, 2011, Raymond A. Wagoner, 60, of East Syracuse was charged with hunting over bait, a violation, and hunting during the closed season, a misdemeanor. He was issued appearance tickets for the Warrensburg Town Court. Wagoner faces maximum possible penalties of $2250 in fines and up to 1 year in jail.

On December 17, 2011, Shane N. Hathaway of Hoosick Falls was charged with possession of a loaded firearm in a motor vehicle, a misdemeanor. Hathaway was issued an appearance ticket for the Town of White Creek Court and faces maximum possible penalties of $1000 in fines and up to 90 days in jail.
